MINUTES OF THE PUBLIC MEETING OF FEBRUARY 10, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in Meeting Room A on the second floor of the Town Hall.

Appointments

7:30 PM with Ben Gilmore of Gilmore Cranberry Co. representing John Ridder, to discuss the water withdrawal permit and the Cranberry Growers Annual Report.

Mr. Gilmore and Mr. Ridder did not show for the meeting.  Ms. Cassady will contact them for information.
Public Hearings

7:45 PM  Abbreviated Notice of Resource Area Delineation (ANRAD) to check the accuracy of the areas of delineation as provided by a DEP Bordering Vegetated Wetland field data form at 30 Holmes Street, Assessor’s Map 75, Lot 5 for Anthony Kolacz, 108 Elm St., E. Bridgewater, MA.  (DEP #175-421)
Craig Nicholson read the public hearing notice and the green cards were checked.  Ken Thomson, representing Anthony Kolacz presented the delineation that he did December 1, 2003.  This is a 6 ½ acre parcel.   There are two streams entering the property.  One is perennial and one intermittent.   Mr. Nicholson read Ms. Cassady’s field report from February 8, 2004.   Her recommendation is that soil observations should be analyzed and that a decision should be postponed until possibly March when the ground isn’t frozen.

8:00 PM  Notice of Intent for a proposed 6-lot subdivision, 2 lots within the 100-foot buffer to an isolated wetland at 1025 Whitman St., Assessor’s Map 102, Lot 18A-4 for Joseph Walsh, SSBD, Inc., P.O. Box 5123, Norwell, MA  02061  (Local Filing #04-01)

Craig Nicholson read the public hearing notice and the green cards were checked.  Brendan Sullivan, an engineer for John Cavanaro Consulting representing owner Joseph Walsh submitted a written request for a variance (attached) with revised plans that call for removal of an existing pool, fence and patio within the 50-foot buffer of an isolated wetland.  The plan, in addition, calls for a detention pond that discharges towards the isolated wetland.  Catch basins will be installed that will filter sediment from the street. The area will be loamed and seeded. There will be separate filings for future construction on the two lots within the 100-foot buffer zone.  Craig read off the abutter’s list for the abutters that were present.  Those present were:

Brian & Karen Downey, 1017 Whitman St. – no questions or comments
Lawrence & Margaret Mishou of 1036 Whitman St. – no questions or comments
Joseph Petrozziello of 1057 Whitman St.  – He gets a ton of water when it rains hard.  He doesn’t know where the water is coming from.  
Brian & Linnea Milligan of 1037 Whitman St. – no questions or comments

Mr. Petrozziello was advised to go to the March 3rd Planning Board Meeting where they will be discussing drainage issues for this subdivision.

8:15 PM  Continued Notice of Intent for repair of a sub-surface disposal system at 116 Woodman Terrace, Assessor’s Map 70, Lot  59 with owner Phillip Beaulieu represented by James Engineering, Inc., 125 Great Rock Rd., Hanover, MA  (DEP #175-416)

Gary James of James Engineering accompanied by Alan Clemons presented revised plans for the septic repair.  They have Board of Health approval.  The haybales have been doubled and extended to the property line per the request of the Commission.

This hearing has been postponed per written request of the owner until February 24, 2004 at 8:00PM. (letter attached)

Orders of Conditions/Determinations of applicability/Certificates of Compliance

Orders of Conditions for construction of a single family house and septic system at Whitman Street, Assessor’s Map 101, Lot 2 for Habitat for Humanity represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #175-420) with special conditions:  1. If the location of the septic system and well are not approved by the Hanson Board of Health, then a Request for an Amended Order of Conditions will have to be submitted to the Hanson Conservation Commission.  2.  Prior to the commencement of construction, a single row of double staked haybales shall be installed as shown on approved plans.  3.A double row of double staked haybales shall be installed around the well area and extend along the 89-foot contour line as a single row.  4.Once all haybales are installed, the Conservation Office shall be contacted to schedule a site visit.  (781-294-4119, Ext. 118)  5.  The easement to be deeded to the Town Conservation Commission shall have a boundary marked with iron pipe.  6.  A copy of the Deed for the easement shall be forwarded to the Conservation Commission.  7.  Prior to the removal of the haybales, all slopes shall be stabilized with vegetation and a site visit shall be conducted by the Conservation Commission. - signed

Determination of Applicability for construction of a swimming pool and landscaping/ grading at 92 Litchfield Lane, Assessor’s Map 118, Lot 19-7 with owner Paul Wynne with special conditions:   1.  The haybales and silt fence that exist on the site currently shall remain intact until all of the approved construction is completed and the area is re-vegetated.  2.  Only the above-ground pool, a 12 x 12 shed at the bottom of the driveway and the removal of trees that have fallen naturally are allowed through this Determination of Applicability.  3.  Any other work on this property, other than that approved, shall be reviewed by the Conservation Commission. - signed

Determination of Applicability for determining whether the boundaries of resource areas depicted on the plan are accurately delineated and whether any proposed work is subject to the
jurisdiction of the Hanson Wetlands Protection By-Law at 662 West Washington St., Assessor’s Map 75, Lot 18-C for John & Charlene Lydon, represented by Vautrinot Land Surveying, Inc., P.O. Box 144, Plympton, MA 02367 with special conditions:   1.  The wetland line that was delineated by Robert Gray, Wetland Scientist for Sabatia was approved by the Commission as accurate.  2.  Any future work proposed within the 100 foot buffer zone of this approved wetland line will require the filing of a Notice of Intent.  3.  This wetland line is approved for up to three years from the issuance of this Determination of Applicability. - signed

Determination of Applicability for repair of a septic system with grading and filling within the 100 foot buffer zone of a bordering vegetated wetland at 67 Meryl Street, Assessor’s Map 80, Lot 145 for Kenneth Caron represented by Alan Dias, P.O. Box 314, Monponsett, MA with special conditions:  1.  Prior to the start of construction, a single row of double staked haybales shall be installed as shown on approved plans and a site inspection shall be scheduled with the Conservation Commission.  2.  The haybales shall remain in place until the backyard has been stabilized with grass/vegetation.  3.  The stakes in the haybales shall be cut so they are flush with the top of the bales to prevent injury.  4.  No work shall take place within the 50 foot no disturb zone.

Request for a Certificate of Compliance for “Complete Certification” at 90 Glenwood Place, Assessor’s Map 70, Lot 26A, owner, Russell G. VerNooy  (DEP #175-275)

Mr. VerNooy attended.  Phil Lindquist read the site inspection report.  It is Ms. Cassady’s recommendation that more research is needed.  Therefore, a decision on his request was postponed.  Mr. VerNooy will be notified.

Discussions

Pertaining to a letter from John McEwan, Superintendent of Schools regarding conservation violations found at the construction site of the new W/H Regional High School project, Ms. Cassady is scheduled to make a site inspection on Thursday, February 12th at 10AM.

In regards to open space, Mr. Lindquist attended an Open Space meeting held last night.  They  are interested in developing the Open Space Plan with the assistance of Conservation.  Since there are already several existing Open Space Plans, Bob Dillon would like to read and possibly change and/or expand on them.  He will be in to pick up copies.
